1. Acceptance of general conditions of sale

The customer acknowledges having read the general conditions of sale at the time of the placing of order and declares to accept them without reservation. These general conditions of sale govern the relationship between Tradition Bière on the one hand and its customer on the other. Both parties accept them without reservation. These general conditions of sale are the only ones to be valid.


2. Quantity

All orders placed on our website and delivered in a country of the European Union are subject to the application of Belgian law and taxes. As a result, the buyer wishing to be delivered to an EU country mandates Tradition Bière to take care of the removal and transport of the goods on his behalf from the Bpost carrier. An individual can not simultaneously control more than 110 liters of beer. Professionals with an appropriate status are not affected by this limitation.


3. Prices

The prices displayed for each product are in Euro all taxes included, excluding shipping. The shipping costs are calculated on the totality of the order. They are applicable during the period of validity mentioned in our commercial offers. Tradition Bière reserves the right to modify its prices at any time but the products will be invoiced on the basis of the prices in force at the moment of the registration of the order.


4. Products

Products are available for sale while stocks last. For products out of stock, our offers are valid subject to availability at our suppliers. If a product is out of stock after the order has been placed, our service will inform the customer by e-mail as soon as possible.


5. Ordering

To place an order, the customer must register beforehand and identify himself on the website. A form is provided to fill in all the information necessary for the creation of the customer account. The customer will follow the instructions to this effect. He / she must provide several pieces of information including his / her name, first name, telephone number, postal and electronic address and billing and delivery address. All information is presented to the client in French or English.
The customer, after having selected the presented products, will validate his order by accepting the general conditions on the one hand and by clicking on the button "I confirm my order" on the other hand. An order number will be assigned. The customer will receive the confirmation of his order as well as his order number by a message displayed on the screen. The customer will also receive a confirmation of his order by mail. Automatic registration systems are considered to be proof of the nature, content and date of the order.
After this step, the order can no longer be canceled, unless authorized by Tradition Bière. Tradition Bière reserves the right to refuse or cancel any order from a customer, in particular in the event of the insolvency of the customer or in the event of a default of payment of the order concerned or of a previous delivery, A dispute relating to the payment of an earlier order. The information indicated by the customer, when entering the information inherent to his order, engages the latter. Tradition Beer can not be held responsible for errors made by the customer in the address of the addressee of the order (delivery address, billing address in particular) and delays in delivery or the impossibility of delivering the products ordered that these Errors could result. In the event of a change of address, the buyer is requested to notify the customer service of Tradition Bière. Tradition Bière can under no circumstances be held responsible in case of computer bug modifying without knowing the price of one or more articles and / or the order. Tradition Bière reserves the right to cancel an order if the amount is not in accordance with the prices normally (in the usual direction) fixed for the products and / or the delivery costs.


6. Transportation - Liability - Claims - Returns

Delivery will be made by the carrier Bpost to the address filled in when the order is placed. The carrier can intervene only after the validation of the order and payment in full. Bank payment agencies will have previously agreed to the payment. If the payment organization refuses payment, the order will automatically be canceled.
Shipping costs are based on destination and number of packages. That is, a package can not exceed the total weight of 20kg. If this weight is exceeded, an additional package(s) will be made. Delivery charges will be multiplied by the number of parcels to be delivered.
The delivery costs can be consulted at any time in the delivery conditions.
By signing the delivery note, the customer accepts the products delivered in the state and therefore no claim relating to damages suffered during the transport will be accepted. It is the responsibility of the customer to carry out all checks and to make any reserves at the arrival of the parcel on the delivery note. Tradition Bière ensures all packages against deterioration and theft during the duration of the transport. It is therefore your responsibility to check the contents of the parcel at the time of delivery and to make reservations if necessary, in the following way: You have a period of 48 hours, on receipt of the parcel, to make any reserves from Tradition Bière in case of missing products or degradation. In case of a breakage, the customer is obliged to send photographs either by mail or by post (Tradition Bière, Rue de la Spaumerie, 10 - 5081 Saint-Denis, Belgium) within 48 hours to receipt of the goods (as evidenced by the postmark).


7. Delivery time

The order is shipped within 24 business hours (from Monday to Friday) maximum by carrier Bpost.
The delivery time varies depending on the destination. Under no circumstances may delivery delays due to breaks in products give rise to compensation and / or damages. Delivery times will only start from the date of delivery of the package (s) to the carrier.
In case of force majeure or exceptional events (natural disaster, epidemic, strikes, lock-outs, etc.) delaying or prohibiting the delivery of the goods, the company Tradition Bière is released from all responsibility.
Tradition Bière can not be held responsible for the failure to respect the delivery times announced by the carrier itself. No compensation or refund can be requested from Tradition Bière in case of delay due to the sole default of the carrier Bpost.
No further compensation for the sums paid in respect of a cancellation may be requested.


8. Customs Prices and Conditions in the EU

The price is expressed in euros "TTC" (all taxes included), packing costs, instructions and tax specific to alcohol (excise) included.
The price indicated on the product sheets does not include transport costs (calculated according to the weight, the number of packages and the destination).
The price indicated in the order confirmation is the final price "TTC" (all taxes included). This price includes the price of the products, the handling costs, the packing costs and the transport costs.
Tradition Bière reserves the right to modify its prices at any time without notice.
The products will be invoiced on the basis of the tariffs in force at the time of the validation of the order.
Tradition Bière reserves the right to cancel an order if the amount was not in agreement with the prices normally set for the products and / or the delivery costs. Each parcel will be accompanied by the invoice in 5 copies.

All beers sold on the Tradition Bière website have been paid for by Belgian customs.
Customs or import taxes may however be requested upon arrival of an order in his country of destination. It is the responsibility of the consignee to pay the customs clearance fees, customs duties and other local taxes of the country of destination. Tradition Bière has no control over these taxes, the recipient can not in any case ask Tradition Bière any compensation or reimbursement related to the costs incurred in the country of destination.


9. Payment and Billing

The invoices can be consulted in the customer area.
Different types of regulations:
- Bank transfer: After the validation of the order, the customer agrees to transfer the amount "TTC" (all taxes included) integral of the order to the bank account of Tradition Bière by mentioning in comment the number of the order. If the payment has not reached the Tradition Bière account within 15 days, the order will be canceled.
- Stripe: The Stripe system allows you to pay online with most credit cards and debit cards. No need to create an account to make payment, you will only need your bank card. Stripe meets the strictest safety standards in the industry. The online store is equipped with an SSL certificate that secures the flow of information between the customer and the site of Tradition Bière.

10. Loss or theft of the package

In case of loss or theft of the parcel due to a problem with the carrier Bpost, it is imperative to inform Tradition Bière as soon as possible.
The loss or theft of the parcel must be signaled by e-mail to the address "info@tradition-biere.com" by enclosing a declaration on the honor of the non-receipt of the parcel. Tradition Bière will conduct an investigation with the carrier Bpost and will inform the customer.
If the package is lost or stolen, Tradition Bière will make a refund by having it on the customer account, subject to compensation from the carrier Bpost.


11. Right of withdrawal

According to the law, the customer has the right to notify Tradition Bière that he waives the purchase he has made, without giving reasons and without having to pay a fine. The withdrawal period is 14 working days following the day following receipt of the order.

In order for the customer to exercise his right of withdrawal, he must return the products intact and in their original condition.

The customer must inform Tradition Bière via the address "info@tradition-biere.com" that he / she renounces his purchase. If all the above requirements are met, a return voucher will be issued by Tradition Bière. The costs of return are always borne by the buyer. The purchaser himself will find a carrier and the goods will travel at the risk of the buyer. Tradition Bière still recommends the carrier Bpost.

The refund of products will be made by bank transfer within 14 days of receipt of the parcel by Tradition Bière. Transportation costs will not be refunded.


12. Legal Warranty and Service

The articles on the site of Tradition Bière benefit, for the most part, from the legal guarantee of conformity, from the legal guarantee of hidden defects and from the guarantee manufacturer whose scope and duration differ according to the brands and the products.

The shipping costs will always be borne by the customer in the context of an exchanged order unless the guarantee of conformity can be applied. In this case, all costs related to this return will be refunded to the customer.

The warranty can not be applied to the repair of damage such as a shock or an accident for example, it can not also be applied to the replacement of consumables such as batteries and others. The guarantee can not be applied to the customer's incorrect handling of the product (see specifications of the manufacturer).

If, by mistake, Tradition Beer comes to deliver a product not conforming to the description described on the site www.tradition-biere.com, Tradition Bière undertakes to replace the product if it is in stock or to provide a voucher, A value identical to the product if it was no longer in stock.

In any case, Tradition Bière can not be held responsible in case of refusal of the manufacturer to apply its guarantee for the reasons explained above.

Any return must be authorized beforehand by Tradition Bière with the assignment of a return number. The customer must therefore make the request to info@tradition-biere.com, after written acceptance of Tradition Bière.


13. Alternative Dispute Resolution

In accordance with Art. 14.1 of Regulation (EU) N° 524/2013, the customer can, if he wishes, go through the alternative settlement platform to resolve a dispute between the customer and Tradition Bière. The customer will be able to access this platform via the address "http://ec.europa.eu/odr" mentioning the address of Tradition Bière, namely "info@tradition-biere.com".


14. Applicable Law

This contract is subject to Belgian law. The language of this contract is French. In the event of a dispute, the Belgian courts will have sole jurisdiction.


15. Personal information

Customer information and data are required to process the order and to communicate between the customer and Tradition Bière. This information is transmitted only to our necessary and indispensable partners and, if necessary, to the customs authorities.
